Terms and Conditions
Effective Date: 07 August 2025 These Terms and Conditions ("Terms") govern your use of the services provided by FJ Design Brand Solutions, operating under The FJ Venture Enterprises Inc. By engaging with our services, you agree to these Terms in full.
1. Collaboration & Communication
1.1 Service Delivery
We aim to provide high-quality services in a timely manner. You will be assigned a point of contact or project manager. Your prompt and clear feedback is critical to project success. Approved deliverables are final; revisions are not permitted after approval.
1.2 Third-Party Platform Issues
We rely on third-party tools and platforms for execution (e.g., social media, hosting services). We are not liable for service interruptions or access issues caused by these platforms but will assist in resolving issues within our control.
1.3 Content Publishing
If you do not successfully connect your accounts or provide platform access, it does not justify a refund. You are entitled to download all deliverables and publish them manually. Posting is a complimentary service and is not refundable.
1.4 Support Channels
Support is provided via email, client dashboard, or live chat only. We do not offer phone support due to the high-volume, low-cost nature of our services.
1.5 Client Delays
Work begins upon signup and onboarding completion. Delays in submitting onboarding forms or approvals do not justify refunds. Payments turn into credits that never expire.
1.6 Approval Timelines
You are expected to provide approval or feedback on deliverables within a reasonable time frame. Delayed approvals will not entitle you to revisions or replacements.
1.7 Professional Communication
We maintain a respectful working environment. Abusive or disrespectful behavior will result in immediate account termination without refund.
1.8 Best Practices
Notify us of any password changes. Review published content regularly. Provide detailed feedback for improvements.
1.9 Storage of Deliverables
Deliverables are stored for up to 90 days. Please download and back up your content within this period. After that, we may permanently delete your files.
2. Refund Policy
2.1 No Refunds
All services are non-refundable due to the manual and digital nature of deliverables. You are paying for our creative time, effort, and intellectual output.
2.2 Connectivity Limitations
Content creation is the core service. Posting/scheduling is complimentary. Issues in connectivity do not qualify for refunds.
2.3 Results Disclaimer
We make no guarantees regarding growth, performance, or engagement. You are purchasing deliverables, not marketing results.
3. Company Obligations
3.1 Right to Refuse
We reserve the right to decline clients at our discretion.
3.2 Policy Changes
Terms, pricing, and services may change. Updates will be posted on our website.
4. Fees & Payments
4.1 Payment Terms
Full payment is due in advance. Subscription clients must have a valid payment method on file. You authorize us to charge recurring fees until canceled.
4.2 Service Continuation
Monthly content creation continues regardless of client feedback or approval. Non-response does not warrant a refund.
4.3 Failed Payments
Services will pause until payment is received. No work will be delivered during suspended periods.
4.4 Cancellation
You may cancel anytime through your dashboard. No prorated refunds are issued.
4.5 Showcase Permission
Unless you request otherwise in writing, we may use your content/logo in our portfolio or marketing.
4.6 Resellers
If you resell our services, you are bound by these terms. You are responsible for collecting from your clients.
4.7 Disputes
By signing up, you agree to resolve disputes through direct communication before initiating third-party complaints.
5. Disclaimers
5.1 Warranty
We provide services "as is." No guarantees are made regarding results or satisfaction.
5.2 Liability
Our liability is limited to the amount paid for services in the previous 30 days.
5.3 Digital Marketing Disclaimer
FJ Design Brand Solutions, under The FJ Venture Enterprises Inc., provides digital services including but not limited to branding, social media marketing, content creation, advertising campaign management (Meta Ads, Google Ads), and digital marketing consulting.
While we are committed to delivering high-quality work and leveraging proven strategies, we do not guarantee specific results such as a fixed number of followers, likes, leads, website traffic, or sales. The performance of any digital marketing campaign can vary based on a range of factors beyond our control, including platform algorithm changes, audience behavior, market conditions, and the client’s level of engagement and cooperation.
Clients are responsible for providing accurate, timely information and approvals necessary to execute campaigns effectively. We will not be held liable for delays or poor results due to incomplete content, lack of access, or unresponsive communication.
Paid advertising services are billed separately (unless otherwise stated), and ad spend is always the responsibility of the client. We do not provide refunds for ad management services once work has begun.
By engaging with our services, you acknowledge and accept these terms.
6. Indemnity
• You agree to indemnify FJ Design Brand Solutions and The FJ Venture Enterprises Inc. against any claims, damages, or losses arising from content, intellectual property, or use of third-party platforms.
7. Confidentiality (NDA)
• We will not share your confidential business information. This includes brand strategies, designs, and trade secrets. Confidentiality extends for two (2) years post-service.
8. Credit Card Disputes
• Disputes must be raised within 14 days of the charge. If a dispute is won against our terms, we reserve the right to invoice the disputed amount and pursue legal action if unpaid.
9. Jurisdiction
• These Terms are governed by the laws of the Province of Ontario, Canada. All legal matters will be resolved under Ontario jurisdiction.
